In the Commonwealth of Virginia, the requirement for an uncontested divorce, also commonly known as a no fault divorce, is to live separate and apart. To meet this requirement for an uncontested divorce, the husband and wife must have lived separately, without interruption, for a period of at least 12 months. If there are no minor children born or adopted by the parties and the parties have a signed separation agreement, an uncontested divorce may be obtained after only 6 months of separation.
I charge a fixed flat fee of $750 for an uncontested divorce. If both parties are in agreement, the turnaround time should be minimal.
A divorce is not considered uncontested if there are any unresolved issues, such as child custody, child support, visitation or alimony.
